The personal data that we process about children and parents is done so in accordance with article 6 & article 9 of the GDPR, our legal basis in Article 6(1)c include: Education Act 1944, 1996, 2002 Education & Adoption Act 2016, Education information about individual pupils England Regulations 2013, Education pupil information England regulations 2005, Education & skill Act 2008. Children Act 1989, 2004, children & families act 2014, Equality Act 2010, SEN regs 2001, we also process information in accordance with Article 6e and article 9(2)G as part of the official authority vested in us as data controller and for reasons of substantial public interest. Such as processing which is not mandatory but is considered to be in our children’s interests, include trips, extra-curricular activities. While some of the child’s information you provide is mandatory, provided to us on a voluntary basis, we would process additional information by ensuring that we ask for your consent before doing so.
We receive, store and share information about you such as:
Names, address, email, telephone numbers, payment methods, DOB, certain information about your business, NI tax information for family and childcare places, this is collected via registration forms, funding applications, booking procedures in paper format sent to us via email or in person by you as well as partaking in surveys and promotions that we carry out.

We collect information to collate educational attainment, government funded places eligibility, attendance, behavioural, safeguarding, and we also process certain ‘special category’ data about children including: SEND (Special educational needs and disabilities), race, ethnicity and religion.
We store relevant medical information, please not that some children who have severe allergy’s or medical issues, when emergency care may be needed is shared with all staff, this information carries photographic identification to alert staff should and emergency arise.
Most of the information we process is obtained from you (children & parents), but we do process information received from the DfE Department of Education, LA Local Authority (City of York), previous nurseries, schools attended. This is shared with other settings that children move onto, LA, DfE, NHS bodies or local primary settings for moderation and tracking purposes.

No information will be shared outside Funfishers without your consent unless we have a lawful basis for doing so. We keep your personal data at Funfishers in accordance with our GDPR policy and statutory obligations. Any personal information which we are not required by law to retain will only be kept for as long as is necessary to fulfil our organisational needs.
