The disclosure of any personal data must be bound to both common law and statute, for example, the Human Rights Act 1998, the GDPR, the Data Protection Act 1998, and the common law duty of confidence. Personal data shared must be justified on the merits of each case and must be proportionate and no more than necessary for the purpose for which it is being shared. Consideration should be given to the relevance of data, to ensure disclosure is not excessive.
